AREth operates this store and website, including all related information, content, features, tools, products, and services related to orders, in order to provide you, the customer, with a curated shopping experience (the "Service"). AREth is powered by Shopify, which enables us to provide the Service to you.

These Terms of Service, together with the policies referenced herein (the "Terms" or "Terms of Service"), describe your rights and responsibilities when you use the Service.

An order is not accepted until AREth confirms acceptance. Before an order is accepted, we must receive and process payment. Because AREth may be unable to accommodate cancellation requests after an order has been accepted, please review your order carefully before submitting it. If we do not accept, change, or cancel an order, we will attempt to notify you using the email address, billing address, and/or phone number provided at the time the order was placed.

You represent and warrant that the products you purchase are for your own personal or household use and not for commercial resale or export.

Section 4 - Pricing and Billing

Prices, discounts, and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be stated in the order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, duties, or import charges.

Section 5 - Shipping and Delivery

We are not responsible for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. We are not liable for delays caused by carriers, customs processing, or events outside our control. Title and risk of loss pass to you when we transfer the products to the carrier.

You must not use such marks without AREth's prior written permission. Shopify's name, logo, product names, service names, designs, and slogans are trademarks of Shopify. All other names, logos, product names, service names, designs, and slogans appearing on the Service are trademarks of their respective owners.

Section 7 - Optional Tools

We may provide you with access to customer tools made available by third-party services as part of the Service, but we neither monitor nor control them, nor do we provide input into them.

You acknowledge and agree that any such tools are provided "as is" and "as available" without warranties, representations, conditions, or endorsements of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that affects the functionality or operation of the Service; (b) reproduce, duplicate, copy, scrape, sell, resell, or exploit any portion of the Service; (c) track the personal information of others; (d) engage in spamming, phishing, fraud, pretexting, or similar conduct; (e) use robots, spiders, scraping tools, data mining or extraction tools, automated devices or processes, AI tools (such as agentic AI), or any other automated or manual means to access the Service; or (f) interfere with, circumvent, or bypass any security features, authorization features, robot exclusion headers, or any other measures we use to restrict access to the Service. To the fullest extent permitted by law, in no event shall AREth, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, or Shopify and its affiliates be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages, including but not limited to lost profits, lost revenue, lost savings, loss of data, replacement costs, or similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise, arising from your use of the Service or any products obtained using the Service, or for any other claim related in any way to your use of the Service or any product, including but not limited to any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content (or product) posted, transmitted, or otherwise made available via the Service, even if advised of their possibility.

You agree to indemnify, defend, and hold harmless AREth, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from and against any loss, damage, liability, or claim, including reasonable attorneys' fees paid to third-party services, arising out of or relating to: (1) your breach of these Terms of Service or any document incorporated by reference herein; (2) your violation of any law or the rights of a third-party service; or (3) your access to and use of the Service.

We will notify you of any indemnifiable claim, but failure to provide prompt notice will not relieve your obligations unless you are materially prejudiced by that delay. We may control the defense and settlement of such claim at your expense, including selection of counsel, but we will not settle any claim requiring non-monetary obligations from you without your consent, which will not be unreasonably withheld. You agree to cooperate in the defense of any indemnifiable claim, including by providing relevant documents.
